Terms of Conditions

1. Provider


The provider of the services is bcation gmbh, Hardturmstrasse 161, 8005 Zurich, Switzerland (hereinafter referred to as the “provider”).


2. Scope of application


These General Terms and Conditions apply to all services of the provider in the field of education and knowledge transfer, in particular continuing education, courses, trainings, workshops and comparable formats offered under the bcation brand. By booking a service, the customer accepts these terms and conditions in their currently valid version.


3. Subject of the contract


The subject of the services is exclusively the transfer of knowledge and education in the field of Bitcoin and related topics. No financial, investment, tax or legal advice is provided. The services do not constitute a recommendation to buy, sell or hold assets.


4. Performance of services


The services are provided by the provider itself or by qualified lecturers acting on behalf of the provider. There is no entitlement to the performance by a specific lecturer unless this has been expressly agreed. The selection of lecturers is based exclusively on professional qualifications and didactic suitability and does not constitute a recommendation of specific products, providers or technical solutions. Explanations relating to products, providers or systems are provided solely in a descriptive and explanatory manner and for educational purposes.


5. Neutrality


Bcation acts independently and neutrally. No recommendation is made for specific products, providers, platforms or services, and the provider does not pursue any sales, brokerage or commission interests. Within the scope of personal instruction, explanatory references to specific products or technical solutions may occur if this serves understanding. These are provided without evaluation, recommendation or encouragement to use them. The decision on any implementation lies solely with the customer at all times.


6. Customer responsibility


The content conveyed serves exclusively for the transfer of knowledge and information. All decisions that the customer makes on the basis of or in connection with the conveyed content are made independently and at the customer’s own risk. Responsibility for actions or omissions lies solely with the customer.


7. No guaranteed success


The provider does not owe any specific success, concrete result or achievement of objectives. In particular, no financial, economic or other results are promised or guaranteed.


8. Remuneration and payment


The prices result from the respective offer and are stated in Swiss francs (CHF) unless otherwise specified. Unless expressly agreed otherwise, the remuneration is due before the start of the service.


9. Online services and technology


For online services, the customer is responsible for ensuring a functioning technical infrastructure. Technical disruptions on the customer’s side do not give rise to any entitlement to reimbursement or compensation. There is no entitlement to recordings or repetitions of online sessions unless this has been expressly agreed. The provider reserves the right to postpone, adjust or cancel services in the event of insufficient participant numbers, for organizational reasons or due to force majeure. Payments already made will be refunded proportionally in such cases or alternative dates will be offered.


10. Appointments, withdrawal and cancellations


Agreed appointments are binding. A cancellation free of charge is possible up to 30 days before the agreed appointment. In the event of later cancellation or non-attendance, the service may be charged in full. If the customer is absent due to personal, professional or health reasons, there is no entitlement to a price reduction, refund or rescheduling unless expressly agreed otherwise.


11. Content and further development


The provider reserves the right to adapt the content, didactic preparation and methodological structure of the services in the interest of professional and didactic development. This does not give rise to any claims by the customer as long as the educational character and the agreed scope of services are maintained.


12. Liability


The provider is liable exclusively for damages resulting from intentional or grossly negligent breaches of duty, to the extent permitted by law. Liability for financial losses, economic decisions, loss of profit as well as indirect damages or consequential damages is excluded.


13. Copyright


All content, documents and materials provided within the scope of the services are protected by copyright. Reproduction, distribution or use beyond the agreed purpose is not permitted without the express written consent of the provider.


14. Data protection


The processing of personal data is carried out in accordance with the applicable data protection regulations. Further information can be found in the separate privacy policy.


15. Final provisions


Swiss law shall apply exclusively. The place of jurisdiction is the registered office of the provider in Zurich, Switzerland. Should individual provisions of these terms and conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
